Fair Use is an Exception to Copyright Law

How Fair Is Fair?

Originally, copyright laws were meant to protect people in creative fields from intellectual property theft.

The judicially-added “fair use” concept allows for the honest exchange of words, music and images for the good of the artistic community and the culture at large.

The four factors judges consider are:

the purpose and character of your use
(for example, in this video : to express myself creatively)

the nature of the copyrighted work
(for example, in this video : mix of lots of different images and sounds + one track recorded on tape 12 years ago on my tape)

the amount and substantiality of the portion taken, and

the effect of the use upon the potential market
(for example, in this video : no idea … at any rate, this is a “not for profit” video).

I created this video with the YouTube Video Editor (http://www.youtube.com/editor) AND Windows Live TM Movie Maker AND a digital cassette logic deck (I don’t know the make, it’s too old and name has worn off) AND a home made PC running Windows 7 Professional OS AND my mobile telephone (Samsung Galaxy SII with Android) AND a photograph camera 😉

This was possible thanks to a connection to the internet provided (at this time) by Orange.

Cube FM 107.9 in the year 2000

It was recorded onto a blank tape which I own and used to mix into this video.

I own the rights of this video I just created and am sharing it for no profit.

I recognise the film “Braveheart” at one point in this video which I do not own but believe is included in this video under the “fair use” act.
